關(guān)于留學(xué)生雇主擔(dān)保免3年經(jīng)驗(yàn)的最新情況

    隨著MODL的取消，雇主提名簽證也受到了影響。最大的影響是特殊情況下的豁免年齡和3年工作經(jīng)驗(yàn)條件變得困難了。
    2010年2月8日之前的移民法規(guī)定，澳洲學(xué)歷的畢業(yè)生，其職業(yè)是在MODL上的只要在畢業(yè)后半年有雇主擔(dān)保，就可以免3年工作經(jīng)驗(yàn)直接申請(qǐng)雇主擔(dān)保移民856或者857；或者年齡超過(guò)45周歲的申請(qǐng)人，只要技能好也可以豁免年齡限制。但是MODL現(xiàn)在沒(méi)有了，無(wú)疑是釜底抽薪，對(duì)留學(xué)生移民申請(qǐng)來(lái)說(shuō)是雪上加霜。那么如何獲得3年工作經(jīng)驗(yàn)豁免呢？
    移民局最新的解釋是，必須滿足2點(diǎn)：
    1. 獲得澳洲學(xué)歷，畢業(yè)后半年內(nèi)
    2. 其評(píng)估職業(yè)在CSL清單上  參考移民局的CSL清單》

    由此可見(jiàn)，CLS清單上部分職業(yè)還是受益的，不過(guò)話又說(shuō)回來(lái)了，CSL本來(lái)移民就快，對(duì)普通留學(xué)生來(lái)說(shuō)，除非雅思不到6，年齡過(guò)45的，CSL職業(yè)做雇主擔(dān)保才有意義，否則直接遞送885，886就可以了。
    另外大量的學(xué)習(xí)廚師、美發(fā)等技工前MODL課程的學(xué)生申請(qǐng)雇主提名會(huì)直接受到影響，因?yàn)樗麄兊牡穆殬I(yè)沒(méi)有MODL而變得很難直接申請(qǐng)ENS雇主擔(dān)保。
    那如果職業(yè)不在CSL清單上是不是一定就不可以免3年工作經(jīng)驗(yàn)申請(qǐng)雇主擔(dān)保呢？
    當(dāng)然不是。即使你的職業(yè)以前在MODL清單上，是不自動(dòng)構(gòu)成豁免3年工作經(jīng)驗(yàn)的特殊情況，但是如果你可以解釋為何你這個(gè)職位在澳洲找不到合適的有高度技能和3年工作經(jīng)驗(yàn)的人手，還是可以獲得批準(zhǔn)的。這一點(diǎn)余地說(shuō)明一些高技能的申請(qǐng)人還有希望去爭(zhēng)取一下的，比如在國(guó)內(nèi)已經(jīng)有工作經(jīng)驗(yàn)的申請(qǐng)人，或者已經(jīng)在澳洲雇主處做過(guò)一段時(shí)間的申請(qǐng)人，或者雇主登了廣告一直找不到更合適人選的申請(qǐng)人。對(duì)于無(wú)法直接申請(qǐng)雇主擔(dān)保的申請(qǐng)人，當(dāng)然還可以考慮其他途徑，比如申請(qǐng)457工作簽證做2-3年工作后轉(zhuǎn)雇主提名，或者理由配偶的TR等簽證獲得額外的工作時(shí)間再轉(zhuǎn)。目前我們還在等待TRA和移民局協(xié)商是否給申請(qǐng)雇主擔(dān)保的技工學(xué)生一個(gè)免除JRP工作準(zhǔn)備項(xiàng)目的評(píng)估模式，讓我們共同期待。

The abolition of the Migration Occupations in Demand List (MODL) has had an effect on applicants for permanent employer sponsored visas.
Although the MODL was not included into the regulations regarding such visas it was referred in the Procedures Advice Manual guidelines in connection with claims of exceptional circumstances.
Set out below is information supplied by DIAC about the effect of the revocation of the MODL on employer nomination visas.
1. MODL revoked on 8 February 2010
The Migration Occupation in Demand List (MODL) was revoked on 8 February based on the findings that the MODL was not effective in delivering a GSM program that meets the future skill needs of the Australian labour market.
2. What is the implication on Employer Nominated Scheme (ENS) and Regional Sponsored Migration Scheme (RSMS)?
a) For applicants who have turned 45, and claim exceptional circumstances on the ''''age'''' criterion:
When making decisions on claims of exceptional circumstances under the age criterion for either ENS or RSMS, case officers will apply the PAM as currently published, except that references to MODL will be taken to be references to the CSL.
b) For applicants who do not have three years work experience:
For new applications received on and after 8 February 2010, when assessing ENS applications from people seeking to meet reg 856.213(b)(i) or 121.211(b)(i) who have a skills assessment but do not have 3 years work experience, case officers will generally consider that exceptional circumstances apply if:
- the applicant completed a qualification of diploma level or higher in Australia in the six months prior to lodging the application AND
- the nominated occupation is on the critical skills list.
 3. What if the student visa holder is nominated for an occupation which is not on the CSL?
If an applicant does not have three years experience but seeks to meet reg 856.213(b)(i) or reg 121.211(b)(i), then holding a recently obtained Australian qualification and nomination of an occupation previously on the MODL will generally not be regarded as sufficient to constitute exceptional circumstances. The applicant needs to make a submission explaining why there are exceptional circumstances, having regard to the current PAM on exceptional circumstances. This generally includes a statement and evidence from the employer or applicant demonstrating that the nominated position is so unusual or highly specialised that it is unlikely a suitable person with at least three years work experience could be found to fill the vacancy.
4. What about the new MODL which was gazetted on 8 February 2010?
A new MODL was introduced on 8 February to apply to a limited number of sub classes in the general skilled migration program. This MODL represents a transitional arrangement for that caseload. It is specifically only intended to apply to those sub classes. It has no  applicability to ENS or RSMS sub classes.
5. Does the current PAM reflect this?
No. The PAM is currently being updated and will be available from 27 March 2010. Since the MODL was revoked on 8 February 2010, all applications made from that date will apply the new policy, even if the application was lodged prior to this date.
